I can't enter the arena on my level 36, I don't have the option to say take me there! Please help, no idea why I can't.

why would I have to be level 40 when shuyal expansion was 36?

It was shuyal gladiator arena but got updated to planar arena. Planar arena was released at level 41 cap.
