I believe it will drop either cap level or -1 cap.
Just like how Shuyal had 40/41 Architect drops.
I believe they do this because there are a decent number of -1 cap running elites normally.
I agree that the loot should be based on the toon's level. If I'm 41, I would expect a level 41 drop.
Loot does not drop at exactly the looter's level. It can be -2, so it's a plus if it is only -1.
I think only crate and other plat chest levels are exact. Everything else varies in levels.

It makes sense, I just don't ever remember this happening before. I can't remember a time (except bael ii) when I didn't get the max level drop from an elite boss. Maybe I've just been lucky

You've been lucky. I have almost always gotten loot 1 lvl under the caps! I think I have the less valuable loot bug. >.< Fortunately for you guys, it doesn't seem to be contagious.
