Question about selling names.

So let me get this straight, is buying/selling names is against TOS or not? If it isn't then how would you prevent getting scammed when doing this? I've been playing since may 2010 and I've always thought it was bannable, but someone told me it isn't. I've also seen people say they're selling names on forums. So...

Please don't post if you aren't sure, only want people who are 100 percent certain.
