Here's what I would do if I were you, first call up Apple let them know what's wrong with your iPod and be honest with them sometimes even if it's out of warranty they are polite enough to issue a refurb. If that doesn't work try going to a local apple store if there is one near you and see if they can do anything about it to issue you a refurb.
If that doesn't work either get it repaired at a local repair shop (It'll be cheaper than going through apple) or just save for a new iPod. Good luck to you.

Still if you can call Apple and they offer a refurb you won't need your parents for you to send it in and get a new one.

I agree that maybe you should try it out. My nephew got a replacement by going to the apple store when his first iPod broke.
A year later I bought him one at Costco and they took it back when it broke. The second one broke, too, and they took that one back, too. You didn't happen to get it at Costco did you? They have a great return policy.
Do you have a nice aunt or uncle who can kind of circumvent your parents? That's what my nephew does when my sister's being "weird like that" lol. I'm the nice aunt.

I just bought a 4th gen. iPod there in Dec. Maybe our local store had a large inventory they're just finishing up? I know that the guy at Costco mentioned that they were ending their contract w. Apple and would stop carrying their stuff. Regardless, they did sell them previously so she may have gotten it there recently and it MAY have fallen under their great return policy, no?

I did a full restore/factory reset on it too... still won't connect to wifi. It's my ipod... craziness... and my parent's are like "it can wait, it's not like you use it for much. You're not allowed to play that dumb game anymore anyway."

here is a thought :). Just search the artists, click the first song only once, shift and then down arrow to highlight all, right click on them, and click check all songs. rinse and repeat for all the music. MAKES IT A LOT FASTER!!!!
