Merging question

So let me get this straight.. I know that merging is against rules, but what if someone were to merge a 76 into a level 15 game and didn't kill anyone. Could that someone still get banned? Sorry if this has been asked before, too lazy to search my butt off for the answer haha.

merge once by accident is bannable, merging pve games is even more severe
