Okay so I was strollin' through Balefort.... And I saw this guy named misterloki. The person had a black shivering ice crossbow? I've never seen one before. Is this a hack? or is this Bannable to have?

Black ice is gained from quests. Finish all the lost expedition quests and Aldo will give you a black ice quest. Another npc gives you a different black ice quest.
One quest is 1000 snowballs and the other is 1000 pelts. To complete the quests you have to go to frozen nightmares. (Harder yetis) 1000 pelts rewards either the black ice auto bow, black ice 2H sword or black ice blast staff. 1000 snowballs rewards either the black ice dagger, black ice axe or black ice wand.

LoL to get the quest, go to ice town, make all quests, and you'll have 2 big ones : Pelts and Launcher quest, and you'll get black ice :D

Black ice is pretty cool lookign but the stats arent better. so its a bit pointless but it is cool.

I sometimes pull out my black ice and people were all somewhat freaking out. I was like -_-'
So I told them what it was
It's a result of the Bubonic Plague. Don't go near it! It kills :(

You most certainly can. Didn't you hear? Black ice is an illegal quest, shipped from the deepest recesses of the Amazon Forest. STS have sent hackers, coders, programmers, even Bill Gates and they can not fix the problem. Anyone caught wearing black ice in public is sentenced to life ban with no parole. That's just the way it is.

Thought he was talking about PL, wearing it around town you can get banned. -_-
