Dark Legends doesnt work on my ipod touch :(

Hey guys and gals, I just tried to down load Dark Legends on my fully updated 3rd generation ipod touch and it says, "this app is incompatible with this ipod touch. This app requires OpenGL ES 2.0 graphics capability."
Please help me down load this app STS and my fellow pl and sl friends.

This site tells you the requirements.

"Compatible with iPhone 3GS, iPhone 4, iPhone 4S, iPod touch (3rd generation), iPod touch (4th generation) and iPad.Requires iOS 4.3 or later."

Do you have iOS 4.3 or above? 3rd Generation is supported, that is what it says here.

If you have ipod touch 3g 8gb it dont work because it counts as ipod touch 2g
