Are you looking at the "Sorcerer's Thyrst Guard Emerald Skull"? - The Thyrst Guard ones have the hat, the others don't.

It's based on 'content level', which is generally the highest player's level clamped into the range the dungeon scales to.
If you are in a zone that scales up to 56, and anyone 56 or higher is...
Not a bug, content level of maus 5-6 for purposes of reflection scaling is 76 with a 76 player present.
Disconnecting thing should be fixed now.

A bug was fixed that this may have been triggering, but there also was an unintended change to it, which will be reverted with today's update.
