Elite maps for non-elite level players

Hello,

Although the general rule is not to be able to run elites under cap-1 level, Lost Cove and Palm Rock in Elite mode are available. I just noticed it by chance with a 38 level char.

This is regarding the loot table coming with the then new elite dragon enclave which scales to the new cap level, and has nothing to do with what I'm stating above.
I am talking about not being able to go to ANY elite map until 40th level, not even Brakenridge Elite, but, as what seems to be a flaw, only in the "hidden"maps of Lost Cove and Palm Rock.
