Item packs wron lev?

So on two different toons in hc mode at lv 55 I have bought item packs for guns and armor, both toons received lv 40-46 items every time.
When you look at it in the store it seems to imply you will get current level items, in this case 55

Btw the items are being upgraded, they aren't in my inv

Hit the info button on the chest in the store, it will show you the exact items you may get including the level of them.

It could maybe be clearer, but is not a bug.
